These Terms and Conditions (“Terms”) govern the relationship between TraduWEB (“the Company”, “we”, “us”) and the client (“the Client”, “you”) regarding the provision of translation, interpretation, and related linguistic services.

1. Acceptance of Terms

By requesting a quote, submitting a purchase order, or using the website https://traduweb.ca/, you agree to be bound by these Terms. No variations to these Terms shall be binding unless agreed upon in writing by TraduWEB.

2. Quotations and Service Orders

  • Validity: All quotes are valid for thirty (30) days from the date of issue.

  • Scope: Quotes are based on the description, word count, and format provided by the Client. Any subsequent changes to the source material or project scope may result in a price adjustment.

  • Binding Agreement: A project is considered confirmed only upon receipt of written approval (email or signed quote) or a formal Purchase Order from the Client.

3. Payment and Fees

  • Rates: Fees are calculated based on word count, hourly rates, or project-based flat fees as specified in the quote.

  • Individual Clients: Full payment is required upfront for all certified document translations (immigration, legal, academic).

  • Corporate Clients: Standard payment terms are Net 15 or Net 30 days from the invoice date, subject to credit approval.

  • Late Fees: Overdue accounts will incur interest at a rate of 1.5% per month (18% per annum).

4. Interpretation Services (On-site & Remote)

  • Equipment: The Client is responsible for providing a safe environment for interpreters and ensuring technical compatibility for Remote Simultaneous Interpretation (RSI).

  • Cancellations: Interpretation requires significant logistical planning. Cancellations must be made in writing:

    • 7+ business days notice: No penalty (except non-refundable deposits).

    • 48 hours to 6 days notice: 50% of the total fee is due.

    • Less than 48 hours notice: 100% of the total fee is due.

5. Delivery and Quality Assurance

  • Timelines: While TraduWEB makes every effort to meet deadlines, we are not liable for delays caused by force majeure or the Client’s failure to provide necessary information.

  • Review Period: The Client has ten (10) business days following delivery to request revisions. Revisions are limited to correcting inaccuracies or omissions. Style preferences not communicated prior to the start of the project are not considered errors.

6. Confidentiality and Data Privacy

  • Non-Disclosure: TraduWEB treats all Client materials as strictly confidential. Documents are only shared with the specific linguists and project managers assigned to the file.

  • Law 25 Compliance: In accordance with Quebec’s Act respecting the protection of personal information in the private sector, we implement rigorous security measures to protect your data.

7. Intellectual Property

Upon full payment of all invoices related to a project, the Client shall own the copyright to the translated work. TraduWEB retains the rights to its internal translation memories, glossaries, and proprietary processes used during production.

8. Limitation of Liability

TraduWEB’s total liability for any claim arising out of the provision of services shall not exceed the total amount paid by the Client for the specific project in question. We are not liable for any indirect, consequential, or punitive damages.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada. Any legal action or proceeding shall be brought exclusively in the courts located in the District of Montreal.
